Kate is experienced in all aspects of litigation involving contractual disputes and claims in tort. Some recent cases involve disputes over a joint venture, construction of clauses in a contract, and issues arising out of the Construction Contracts Act. Kate has had extensive experience in weathertight homes issues as both a mediator and a litigator.

Kate is a specialist in Equity, Trusts and Estates. She has been involved as counsel in many significant cases in this area. She is a co-author of Lexis Nexis, Law of Trusts. Recent examples of her cases include litigation on removal of trustees, interpretation of Wills and claims by beneficiaries on estates and trusts. Kate has written and lectured extensively in this area.

Land Law and Unit Titles Act

Kate is an expert in Land Law and the Unit Titles Act. She successfully argued the first ever appeal to the Privy Council by Cook Island appellants. This case involved a 100-year-old land claim. She has appeared on many different caveat, easement, and nuisance arguments.

As Kate is a specialist in trust law she is frequently asked to become involved in Relationship Property cases. Kate advises on all aspects of relationship property. She has recently acted for third party trustees defending a claim brought by a non-related spouse.

Medico Legal/Health Law

Kate has for many years specialised in Medico Legal issues, including appearing in NZ’s first “Right to Die” case. She has appeared in many inquests, ACC cases & health related litigation. Kate has a keen interest in assisted reproduction having chaired New Zealand’s Ethics Committee on assisted reproductive technology for 7 years. She has appeared in many ACC cases and has appeared for both defence and prosecution in health and legal related disciplinary cases.

Professional Regulation

Kate has an active involvement in professional regulation. She was Deputy Chair of the Health Practitioners Disciplinary Tribunal for 9 years and is now Deputy Chair of the Real Estate Agents Disciplinary Tribunal. She has appeared in numerous High Court, Court of Appeal and Supreme Court cases as counsel.
